A person who consults with an attorney about the possibility of forming an attorney-client relationship with respect to a matter is a prospective client.  Generally, an attorney-client relationship does NOT form until both parties, the attorney and client agree to it.  Even when no client-lawyer relationship ensues, a lawyer who has learned confidential information from a prospective client shall not use or reveal that information, except as the Rules of Professional Conduct would permit with respect to confidential information of a former client.
